HC for filing case over death of Brahmanbaria trader in RAB custody

DHAKA, Feb 6, 2025 (BSS) - The High Court (HC) today passed an order asking authorities concerned to accept the allegation of the death of Brahmanbaria trader Shahnur Alam in RAB custody in 2014 as a regular case. 
 
A High Court division bench of Justice Md Mostafizur Rahman and Justice Md Sagir Hossain passed the order, declaring absolute a rule issued earlier in this regard. 
 
"This rule was not heard in the last 10 years. After the July-August mass uprising, we placed the matter before the court for the hearing. The court today declared the rule absolute, clearing the legal bar to accept the allegation as a case," said Barrister Ashfak Rahman, who moved a plea before the court. 
 
According to the case documents, Shahnur was picked up from his house by the members of RAB-14 on April 29, 2014. They tortured him inhumanly and later admitted him to Cumilla Medical College Hospital, where Shahnur succumbed to his injuries on May 6, 2014. 
 
Shahnur's brother Mehedi Hasan filed a complaint petition with Brahmanbaria Judicial Magistrate Court against nine members of RAB-14 on June 1, 2014. The court later asked CID to accept the matter as a case and probe the matter. 
 
An accused RAB official, however, filed a review petition with the Brahmanbaria District and Sessions Judge Court against the magistrate court order. 

The court, after holding a hearing on the matter, cancelled the magistrate court order and asked the officer in charge of Nabinagar Police Station to probe and take legal action. Victim's brother Mehedi Hasan appealed against this order with the High Court. 
 
The High Court on July 16, 2014, issued a rule, asking authorities concerned to explain why it shall not cancel the order of Brahmanbaria District and Sessions Judge Court. The court today came up with its order, declaring absolute this rule.
