Govt promulgates ordinance giving indemnity to July uprising participants

DHAKA, Jan 26, 2026 (BSS)- The government has issued the 'July Mass Uprising Protection and Liability Determination Ordinance 2026' which is effective from July 1, 2024.

The ordinance is aiming to legally protect and remove cases filed against the participants in the mass uprising held in July-August months in 2024.

A gazette related to this has been issued from the legislative and parliament affairs division of the Law, Justice and Parliament Affairs Ministry on Sunday.

The students and people who participated in the July Mass Uprising started on July 1 in 2024 have been designated as the ‘Gono abhutthankari’ in the ordinance.

The ordinance said all the civil and criminal cases filed against the participants who have staged this movement for restoring democracy, human rights and rule of law and ousting the fascist ruler will be scrapped.

The ordinance stated that any case or legal procedure filed against the July uprising participants will be removed by the court immediately at the plea of the public prosecutor.

Alongside, the court will acquit the accused person and no fresh cases will be lodged in future related to this.

The ordinance also has been defined clear difference between political resistances and criminal abuse of chaotic situation, saying that if there is any allegation of committing murder against any uprising participants then it will be submitted to the human rights commission.

If the commission finds that the act of murder was a part of political resistance then no cases will be filed against the particular participants.  But the commission may instruct the government to give compensation to the victim families. 

According to the human rights commissions prove that any killing was committed as own interest of criminal abuse instead of political resistance then the commission will submit report to the concerned court  and the court will start subsequent process considering the report as the police report.

The president has promulgated the ordinance according to the power bestowed on him in the article 93(1) of the constitution.

The parliament now remains in dissolve state and the legal safety has been ensured and it is required to take immediate action considering the emerging situation.

The ordinance will get priority on any other laws in the country.
